A 30-year-old Ottawa man accused of not disclosing his HIV status to sexual partners has cancelled his request for a bail review in Superior Court.
The accused had asked for a bail hearing after a preliminary hearing last month, where Justice David Wake dropped four attempt murder charges after ruling death from HIV is a “possible consequence” but no longer an “inevitable consequence or even a probable consequence” of contracting the virus.
The accused faces 21 charges, including three counts of aggravated sexual assault, one count of attempted aggravated sexual assault, three counts of sexual assault, two counts of administering a noxious thing, two counts of attempting to administer a noxious thing. He also faces eight counts of breaching probation and two counts of possession of child pornography.
The accused already had two unsuccessful bail reviews. In July 2010, he was granted bail, but a few days later it was revoked and he was transported to a Milton jail to face a Waterloo arrest warrant for similar charges. Last December, he was denied bail again.
In Kitchener, the accused faces three counts of aggravated sexual assault and two counts of failure to comply with probation conditions. His pretrial motion date in Kitchener is Nov 28, and jury selection will commence Feb 27, 2012.
The accused will be in Ottawa Superior Court Sept 30.
To date, the accused has been jailed in protective custody for nearly 16 months.
Last year, Ottawa police set off nationwide debate after his photo was attached to an email sent out by the Police Liaison Committee to the queer community with the phrase “sexual predator” attached to it.
