BC Supreme Court Justice Laura Gerow cleared the way for gay divorce in BC, Jun 15.
She ruled that the section of BC’s Divorce Act which defined spouses as “a man and a woman” needed to be changed to “two persons.”
The ruling allows BC’s first gay divorcees to legitimize the dissolution of their relationship. Prior to Gerow’s ruling, gay people could get married in BC, but there was no legal mechanism for divorce.
The former couple who can be identified only as JS and CF separated May 26, 2004 after 10 months of marriage.
